Terms and Conditions for Activating Trinity account

I/We hereby authorize Kotak Securities Limited (KSL) to carry out the following acts, matters, and things in relation to my/our linked bank account and Trading/Demat account maintained with KSL, and further agree, confirm, and consent to the following:

a) Facilitate my/our securities transactions smoothly and for meeting settlement obligations, margin requirements, recovery of any outstanding amounts due in connection with trades executed by me/us through KSL, and for meeting obligations arising out of subscriptions to products/facilities/services through KSL including but not limited to Mutual Funds, Public Issues (shares and debentures), Rights Issues, Offers for Sale, or any monies/fees/charges payable by me/us to KSL in its capacity as stock broker and/or depository participant.

b) I/We further authorise KSL to debit my/our designated Kotak Mahindra Bank Ltd. (KMBL) account for the purpose of investment in Mutual Funds, PMS, AIFs, Venture Capital Funds, SGBs, Corporate Fixed Deposits and any other such investments on my/our behalf.

c) I/We confirm that I/We have given a mandate to debit my/our bank account and CRN maintained with KMBL for the above purposes.

d) I/We agree that in case of any amount due to me/us towards my/our accounts with KSL, KSL may raise its demand to KMBL and KMBL shall duly honour such instructions, provided always that KMBL shall have a prior charge on the balances maintained in my/our account in respect of any amounts due and payable by me/us to KMBL.

e) I/We undertake to maintain adequate balance in my/our bank account with KMBL to ensure that debit instructions issued by KSL are duly honoured.

f) I/We further undertake that any disputes arising out of transactions between me/us and KSL shall be resolved directly with KSL and I/We shall not raise such disputes with KMBL nor issue any contrary instructions to KMBL.

g) I/we consent to sharing of account and transaction data between KSL and KMBL solely for the purpose of enabling, implementing and maintaining the Trinity facility.
